1. Definitions

  • "Company", "we", "our", or "us" refers to Cliqqa AI.
  • "Client", "you", or "your" refers to any person or business using our platform or services.
  • "Lead" means a prospective customer's contact details and information that has been pre-qualified according to the criteria configured on the platform.
  • "Services" refers to the Cliqqa AI platform, including funnel building, lead capture, OTP verification, AI qualification, buyer routing, and related tools.
  • "Platform" means the Cliqqa AI application.

2. Acceptable Use

By accessing and using our platform, you agree that you will not:

  • Use the platform for any unlawful or fraudulent purpose.
  • Attempt to gain unauthorized access to our systems or networks.
  • Upload, transmit, or distribute any harmful code, malware, or spam.
  • Copy, modify, or distribute any content from our platform without prior written permission.
  • Engage in any activity that may damage or interfere with the operation of the platform.

We reserve the right to suspend or restrict access to any user who violates these rules.

3. Our Services

  • Cliqqa AI provides tools for building lead capture funnels, OTP verification, AI voice qualification, live call transfers, buyer routing, and analytics.
  • Service availability and features depend on the selected subscription plan.
  • There are no long-term contracts unless explicitly agreed. You may cancel at any time.

4. Lead Qualification & Delivery

  • A "qualified lead" is defined according to the criteria configured by the Client within the platform.
  • Leads are delivered via the method configured (email, CRM integration, webhook, etc.).
  • Cliqqa AI does not guarantee sales, conversions, or revenue outcomes from delivered leads.
  • It is the Client's responsibility to follow up with leads promptly.

5. Payment Terms

  • Clients are billed according to their selected subscription plan.
  • Payments must be made according to invoice terms.
  • Failure to pay may result in suspension of services until the account is settled.

6. Refunds & Disputes

  • Refunds will only be issued where service was materially not delivered as described.
  • Disputes must be raised in writing within 5 business days.
  • We may provide account credit or service extension after verifying a claim.

7. Cancellations

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. No refunds are provided for partial billing periods.

8. Client Responsibilities

Clients must:

  • Use leads for lawful business purposes only.
  • Comply with all applicable U.S. marketing and data protection laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and California Consumer Privacy Act (CCPA) if applicable.
  • Maintain the confidentiality of their account credentials.

Cliqqa AI is not responsible for any misuse of leads or platform data after delivery.

9. Intellectual Property

  • All platform content, branding, text, graphics, and materials are owned by Cliqqa AI unless otherwise stated.
  • You may not copy, reproduce, or redistribute any content without our prior written consent.
  • Content you create using the platform (funnels, forms, etc.) belongs to you.

10. Disclaimers

  • The platform and services are provided "as is" without warranties of any kind.
  • We do not guarantee uninterrupted access to the platform.
  • While we strive to deliver high-quality services, we make no guarantee of specific business outcomes.

11. Limitation of Liability

To the maximum extent permitted by law, Cliqqa AI will not be liable for any indirect, incidental, or consequential damages arising from the use of our platform or services. Our total liability is limited to the amount you paid to us in the 12 months preceding the claim.

12. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the United States of America, and specifically the laws of the State of Virginia, without regard to conflict of law principles. Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in Virginia.

13. Changes to These Terms

Cliqqa AI may update these Terms at any time. Changes will take effect once posted on our website. Your continued use of our platform or services means you accept the updated Terms.
